Terms of Sale

1. Purpose

These Terms of Sale define the conditions under which CapWind Group provides its subscription services to the CapYacht platform.

2. Services offered

CapYacht offers three plans:

• Free (€0/month) : 1 boat, mini site, iCal sync, WhatsApp, email notifications
• Zen (€9.90/month) : up to 5 properties, seasonal pricing, advanced stats, iCal export, priority support
• Business (custom) : unlimited properties, custom domain, API, multi-user, account manager

3. Price and payment

Prices are indicated in euros including tax. Payment is made monthly by credit card via a secure payment provider (Stripe). Billing starts upon subscription.

4. Duration and termination

Subscriptions are without commitment. The user can cancel at any time from their customer area. Cancellation takes effect at the end of the current period, without pro-rata refund.

5. Right of withdrawal

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal does not apply to services fully performed before the end of the withdrawal period with the consumer's agreement.

6. Guarantees

CapYacht undertakes to provide a service available 99.9% of the time (excluding scheduled maintenance). In case of prolonged unavailability (>24h), a proportional credit will be granted.

7. Role of the platform

CapYacht is a technical tool allowing owners to create their direct booking site. The platform acts as a host within the meaning of LCEN and is not party to transactions between owners and travelers.

CapYacht does not verify the identity of owners, the actual ownership of properties, nor the compliance of accommodations with current standards. The user is solely responsible for compliance with applicable regulations (town hall declaration, tourist tax, insurance, etc.).

8. Limitation of liability

CapYacht's total liability is, in all circumstances, limited to the amount of the subscription actually paid by the user during the last 12 months.

CapYacht cannot be held responsible for:

• Content, listings or information published by users
• Fake listings, scams or fraudulent practices committed by users
• Disputes, claims or damages between owners and travelers
• Financial losses, indirect damages, loss of revenue or moral prejudice
• Temporary service unavailability (maintenance, force majeure)

9. User obligations

The user guarantees:

• To be the legitimate owner or authorized manager of the published properties
• That the published information is accurate, truthful and up to date
• That they comply with current legislation (urban planning, taxation, security)

In case of breach, the user undertakes to indemnify CapWind Group for any damage suffered.indemnify CapWind Group for any damage suffered.

10. Personal data

Data is hosted in Europe (Supabase, AWS infrastructure). It is never sold to third parties. See our privacy policy.

11. Applicable law

These Terms of Sale are subject to French law. Any dispute will be brought before the competent courts of Nice.
